NEET UG 2024 Hearing Live Updates: The Supreme Court is hearing on a batch of pleas seeking cancellation, re-test and a court-monitored probe into the NEET UG 2024 exam held on May 5 this year. 

Advocate Mathews J Nedumpara, appearing for petitioners, said in the SC on Monday that the paper leak leak industry is worth 2500 crores. “50,000 govt medical seats are there. Capitation fee is anything between 50 lakh to 1 crore. Leak has been happening for many many years, 2013, 2014, 2016," Nedumpara said.

Earlier, senior advocate Narender Hooda, appearing for petitioners-students, told the Supreme Court that if this Court was not considering re-NEET, at least qualified people should be asked to re-take the exam, which will be about 13 lakh people, legal news website LiveLaw reported. Earlier Hooda also informed the top court that since the paper leak took place through WhatsApp, it was impossible that it was confined only to Patna in Bihar. 

In the previous hearing on July 18, the Apex Court bench of Chief Justice of India DY Chandrachud and Justices JB Pardiwala and Manoj Misra heard directed the National Testing Authority (NTA) to the results of NEET UG 24 exam on their website – city-wise and centre-wise masking the identity of the candidates.

The NTA published the results on its website on Saturday, July 20, as directed by the Supreme Court.

NTA's Additional Affidavit

The NTA has filed an additional affidavit in the Supreme Court in the NEET UG 2024 case, according to legal news website LiveLaw. In the affidavit, the NTA has refuted petitioners’ allegation of conflict of interest on the part of IIT-M Director, who prepared the data analytics report.

The petitioners in the paper leak case have also filed an Intervention Application (IA) in the Supreme Court. The application has requested a retest for the nearly 3.5 lakh top scorers in the test. The petitioners said that they too have scored fairly high marks on the test — from 650 to 680 out of the total 720 marks.

What happened in last hearing?

In the July 18 hearing, the top court also flagged the NTA's “hypothesis" that the paper was “leaked", solved and memorised by students within just 45 minutes. The lawyer appearing for one of the petitioner alleged that there was increase in the syllabus for the exam and the changes were notified just few months before. He also said the transportation of the question papers was compromised in Hazaribag.

Earlier in the day, CJI DY Chandrachud told the petitioners that they needed to prove that the paper leak was ‘systemic’ and affected the entire examination so as to warrant the cancellation of the entire exam. The re-examination has to be on concrete footing that the sanctity of entire test was affected, the CJI said, according to a report on legal news website LiveLaw.

What is the government's version

The Union government has, in its affidavit, informed the Supreme Court that there was no evidence of widespread cheating or specific groups of candidates unfairly benefiting from abnormal scores in NEET UG 2024. The government also informed the Court that the Ministry of Education had requested IIT Madras to conduct comprehensive data analytics of the NEET-UG 2024 results.

NEET-UG 2024 was taken by 23.33 lakh students on May 5 across 4,750 centres in 571 cities, including 14 cities overseas. Conducted by the NTA, NEET UG is the entrance test for admissions to MBBS, BDS, AYUSH, and other related courses in government and private institutions nationwide.

NEET-UG 2024 results: 37 of the 50 top-scoring NEET centres are clustered in Rajasthan’s Sikar district

An analysis of NEET-UG 2024 results shows that many students scoring high marks were clustered in particular centres located in certain cities or States. The National Testing Agency published the undergraduate medical entrance examination scores of 23,33,162 candidates on Saturday after the Supreme Court directed that the data be made public.

Of the 50 NEET-UG exam centres which had the highest percentage of candidates scoring above 650, 37 centres are located in Rajasthan’s Sikar district alone. A score of above 650 gives candidates a chance of getting admission in government medical colleges.

“Of the 30,204 students who bagged over 650 marks, and will compete for 20,000 highly coveted MBBS seats in government medical colleges, 2,037 bagged scores above 650 in Sikar alone. The CBI should definitely look at this anomaly,” said Krishan Sharma, the parent of an aggrieved candidate in Haryana. Dr. Sharma is one of the petitioners in the Supreme Court in the NEET-UG 2024 paper leak case.

NEET UG Result 2024: The National Testing Agency (NTA) on Saturday, July 20, published the centre and city-wise NEET UG Result 2024 on its official website — exams.nta.ac.in/NEET/ and neet.ntaonline.in. These results have been released in compliance with Supreme Court's order.

This year, the NEET UG main exam was held on May 5, 2024, and the results were released on June 4, 2024. Approximately 24 lakh candidates participated in the exam which were held at 4,750 centres in 571 cities, including 14 cities overseas. The re-test was held on June 23, 2024, while the results announced on June 30, 2024. A total of 1,563 candidates participated in this examination.

NEET UG 2024 SC Hearing Live: The Supreme Court today said that any order for conducting the NEET-UG 2024 afresh has to be on the concrete footing that the sanctity of the entire medical entrance exam was affected. The counsel, as per LiveLaw, told the top court that the NTA has said that the inflation of the mark is attributed to the decrease in the syllabus, however, there is an increase and decrease in the syllabus. “They are not talking about the increase in syllabus. I can show the increased portions,” counsel argued.

The judges further ask about the spread of NEET question papers. “The idea of somebody doing this is not to make a national charade of NEET exam. People were doing it for money. Therefore anybody who is making money out of it won’t circulate it mass scale,” said CJI Chandrachud adding: “Does somebody pay 75,000 for 45 minutes?”

The top court further discusses two possibilities of the NEET paper leak. “One the paper gets leaked before the custody of banks. That means, it happened before May 3. Second, the leak happened when the papers left the banks and were bound for the centre,” said CJI.

While hearing on marks inflation and alleged paper leak, the top court has asked the NTA to inform that out of the students who changed exam cities, how many made it to the top 1.08 lakh and is there any skew in favour of those who registered on April 9 and 10?

The apex court is hearing nearly 40 pleas related to the alleged irregularities on National Eligibility cum Entrance Test (Undergraduate).

The counsel has alleged irregularity in the IIT Madras report submitted at the apex court. “One Hardayal School from Bahadurgarh has a special story…there were 6 people…What happened in Bahadurgarh is glaring. NTA never disclosed that the question paper taken from Canara Bank was distributed. There was no delay. The principal of school is on record that they collected papers from SBI and Canara Bank,” said Hooda, as per LiveLaw.

According to Live Law, the CJI told the petitioners: “You have to show us that the leak was so systemic and affected the entire examination so as to warrant the cancellation of the entire exam. The re-examination has to be on concrete footing that the sanctity of entire test was affected.”

The top court judges also said that the CBI probe is on. If what the agency has told us is revealed, it will affect the investigation, people will become wise, as per PTI.

Meanwhile, the CBI has questioned three students from AIIMS Patna in connection with the NEET UG paper leak case. However, further details on the students being quizzed were not immediately known, as per PTI.

CBI arrests man who stole NEET-UG paper from NTA's trunk

The CBI arrested Pankaj from Patna and Rajkumar Singh alias Raju from Hazaribagh in Jharkhand. Pankaj is accused of stealing the NEET paper.

Earlier this month, the CBI arrested the main accused, Rakesh Ranjan alias Rocky, from Bihar's Nalanda.

Rakesh Ranjan is believed to be one of the key players in the NEET paper leak. The CBI set a trap and conducted raids at four locations in Patna and Kolkata to arrest Ranjan.

The agency has so far arrested over a dozen people to unravel the the conspiracy that triggered a massive political storm.

The CBI has been utilising advanced investigative techniques to track down and apprehend those involved.

"Ranjan was located and identified through a detailed analysis of digital footprints, including IP addresses and email communications, underscoring the agency's dedication to employing cutting-edge technology in its efforts to combat corruption and fraud," an official had told ANI.

The NEET-UG exam, held on May 5, 2024, was marred with allegations of cheating and paper leaks. There were discrepancies in the evaluation process as well, as 67 aspirants scored full 720 marks.

The National Testing Agency (NTA), which conducted the exam, faced severe criticism. The government removed the NTA chief and formed a panel to review and improve its functioning.

The National Eligibility-cum-Entrance Test-Undergraduate (NEET-UG) is conducted by the NTA for admissions to MBBS, BDS, AYUSH and other related courses in government and private institutions across the country.

Over 23.33 lakh students had taken the test on May 5 at 4,750 centres in 571 cities, including in 14 cities overseas.

The Supreme Court today (July 15) issued notice in the transfer petitions filed by the National Testing Agency (NTA) concerning NEET-UG 2024 cases pending before the Rajasthan High Court

Before the High Court, a batch of writ petitions was filed challenging the NEET examination. However, the NTA moved to the Top Court seeking the transfer of the petitions to the already pending batch of matters before it.

The bench of CJI DY Chandrachud and Justices JB Pardiwala and Manoj Misra agreed to issue notice in the transfer petitions and tag them with the lead case Vanishika Yadav v.UOI relating to the ongoing NEETUG controversy.

" Issue notice and tag" The CJI directed during the hearing.

Advocate Vardhaman Kaushik, the Counsel for NTA, also requested the Court to stay the proceedings before the High Court. To which the CJI clarified that procedurally when the Supreme Court issues notice in a Transfer Petition, the High Courts do not proceed with the matter.

" In Transfer, the High Court normally doesn't proceed"

The petitions pending in Rajasthan High Courtin in which notices are issued are as follows :

1. National Testing Agency Versus Durgesh Raj And Ors. T.P.(C) No. 001741 - / 2024

2. National Testing Agency Versus Tanuja Yadav T.P.(C) No. 1735/2024

3. National Testing Agency Versus Yashasvini And Ors. T.P.(C) No. 1730/2024

4. Aarushi Singh Versus National Testing Agency And Ors. W.P.(C) No. 449/2024

5. National Testing Agency Versus Anshu Choudhary T.P.(C) No. 1737/2024

The tagged petitions will now be heard together with the main batch on Thursday.

It may be noted that on June 14 the Top Court also issued notice in similar transfer petitions filed by NTA. The transfer sought was of pleas challenging the award of grace marks as well as the alleged paper leak concerning the NEET filed before the Delhi High Court. Subsequently, on June 20 the Court stayed proceedings in petitions filed in Rajasthan, Calcutta and Bombay High Courts regarding the alleged paper leak in the NEET-UG 2024 exam and tagged the petitions with the main matter.

What Is The NEET-UG Matter About?

Notice was issued on May 17 in the lead petition titled Vanshika Yadav v. Union of India which seeks the re-conduct of NEET UG 2024, in light of the alleged malpractices and paper leak of the exam.

While the top Court refused to grant a stay on the results of the NEET-UG 2024 exam, the bench led by CJI DY Chandrachud agreed to consider the matter and posted it for hearing after summer vacations (in July).

Several petitions have been filed before the top Court since, alleging that the nationwide examination held on May 5 by NTA was riddled with malpractices as various instances of paper leaks came to light. Subsequent to the declaration of the NEET-UG Results, additional pleas were raised against the 'arbitrary' grant of grace marks to 1536 candidates on grounds of 'loss of time' purportedly to give 'back-door entry' to certain individuals.

One of the petitions in the batch seeks recall of the NEET-UG 2024 results and the conduct of a fresh examination. Other petitions seek a CBI investigation into the alleged malpractices in the conduct of the exam. Notice has been issued in these matters and they have been tagged for a combined hearing.

Opposing the calls for 're-NEET' and cancelling results of the NEET-UG 2024 exam, a petition has also been filed in the Supreme Court by 56 Gujarat-based medical students for not re-conducting NEET afresh.

Another petition alleges, among other things, the involvement of NTA officers in manipulating the OMR sheets.

On July 8, the Court posed questions to the Union Government and NTA regarding the nature of the paper leak and steps taken to identify the beneficiaries of fraudulent practices. Stating that the occurrence of the paper leak in the NEET-UG exam could not be denied, it further said that what remained to be ascertained was if the nature of the leak was widespread or isolated, in order to decide the question of ordering a re-test.

Subsequently, the Union in its affidavit on July 10 denied any mass malpractice in the NEET-UG 2024 exam. It said that the data analytics done by the Indian Institute of Technology Madras showed that mark distribution followed a bell-shaped curve that is seen in any large-scale exam, indicating no abnormalities.

The NTA also submitted that the video showing a photo of the NEET UG exam paper leaked on Telegram on May 4 was fake. As per NTA, the timestamp was manipulated to create a false impression of an early leak.

NEET-UG 2024 row: Supreme Court issues notice on NTA plea to transfer NEET cases in High Courts to top court

The Supreme Court on July 15 sought responses from students-petitioners to a request made by the National Testing Agency [NTA], which is under a cloud over the conduct of NEET-UG 2024 marred by leaks and other irregularities, to transfer their pleas pending in High Courts to the Supreme Court.

A Bench headed by Chief Justice of India D.Y. Chandrachud issued notice to the students, who are the petitioners in the High Courts.

NTA had applied to the Supreme Court to transfer the pending cases in the High Courts to the Supreme Court for an authoritative ruling.

The three-judge Bench of the Chief Justice and Justices J.B. Pardiwala and Manoj Misra are hearing over 40 separate petitions seeking various reliefs from fresh NEET to abolishment of the NTA itself.

The NTA has urged the Supreme Court to tag its petitions to transfer the High Court cases with these petitions.

The Supreme Court is scheduled to hear the NEET case on July 18. The primary question before the Supreme Court is whether or not to order a re-test. The court has indicated that its first priority is to examine whether the wrongdoers among the exam-takers could be segregated from the innocent students.

The court has made it clear that it did not want to pass any orders which would upset the future of 23 lakh students who took NEET on May 5.

The Central Bureau of Investigation (CBI) on Thursday arrested the alleged kingpin of the Bihar NEET-UG case from Patna.

After his arrest, the probe agency conducted searches at various locations connected to him in Patna and Kolkata, which led to the recovery of several incriminating documents, officials said.

Meanwhile, a local court has granted 10-day custody of the main accused to the CBI for interrogation.

NEET-UG 2024 Supreme Court Hearing LIVE: The NEET-UG 2024 was conducted on May 5 for 23.33 lakh students at 4,750 centres in 571 cities, including in 14 cities overseas. The results were released on June 4, however, soon after, owing to a large number of toppers, reports of a paper leak surfaced on social media. The CBI is currently investigating six related to the same. Several aspirants filed a batch of petitions regarding the alleged paper leaks and irregularities in the NEET-UG 2024 exam today. The students also demanded a re-exam. During the court proceedings on July 8, Chief Justice D.Y. Chandrachud noted that the sanctity of the exam has been compromised and the extent of paper leak is important to decide whether the exam held on May 5 be cancelled or not. The CJI directed all counsels for petitioners who wish for a NEET UG 2024 re-test to file a common set of submissions not exceeding 10 pages and highlighted that a retest would be the “last resort”. The CJI has now listed the matter for hearing on July 18.
